The fight over Chinese open-source AI is really a fight over who profits from it

Last month a Chinese lab called Moonshot released an AI model called Kimi K3. It is an open-weight model, meaning anyone can download the core software, run it on their own computers, and adapt it however they like. It is currently the largest such model in the world.

That single release sent shockwaves through Washington and Silicon Valley.

OpenAI's head of strategic futures, Dean W. Ball, argued publicly that the US government should manufacture regulatory uncertainty around Chinese open-weight models to discourage people from using them. Tech figures including Yann LeCun, the chief AI scientist at Meta, pushed back hard. Ball quickly retracted his suggestion.

But the political pressure has not gone away. TechCrunch AI first reported that the Trump administration is actively weighing a ban on Kimi K3 and similar Chinese models. A separate report from Politico said the Department of Commerce does not plan to act soon.

So what is actually going on?

The economics are blunt. Open-weight models are cheap. A business can download Kimi K3, run it on its own servers, and pay nothing to OpenAI or Anthropic, companies that have spent billions training their own closed, subscription-based models. Braden Hancock, co-founder of AI company Snorkel AI and a former Meta director, told TechCrunch AI: "Strong, frontier-caliber open source models will place a squeeze on the margins and will bring down the prices of the frontier companies."

That is great for ordinary users and businesses. It is uncomfortable for investors who backed those frontier labs.

Should Americans be worried about using Kimi K3?

The short answer is: it depends on what risk you mean. Four concerns circulate in Washington, and they are not equally serious.

First, data privacy. Could Kimi K3 quietly send your data back to the Chinese government? Experts say models running on US servers make that very hard, though not technically impossible. Second, hidden bias toward Chinese government positions. That sounds alarming, but for most business uses, like writing code or summarising documents, it is hard to see the practical impact. Third, weaker safety guardrails. US models are required through a government process to refuse certain sensitive requests. Chinese models often have no such restrictions, which is itself a double-edged point: David Sacks, a venture capitalist and Trump adviser, has noted that some US companies are already turning to Chinese models precisely because American ones refuse legitimate security tasks.

The fourth concern is the most consequential. If Chinese open-weight models become the foundation that global researchers build on, China effectively shapes the direction of the entire field. Half the papers US graduate students study now come from Chinese institutions, and US frontier labs are increasingly reluctant to share their own research publicly.

"The bigger impact of having these open-source models come from China is less that they're sneaking in back doors, and more that they are owning the innovation," Hancock said.

Bresnick offers a cleaner fix: tighten controls on selling Nvidia H200 processors, the specialised chips that power AI training, to Chinese firms. "That," he says, "could potentially keep us out of this thorny debate about banning open-source technologies that huge numbers of US companies want to use."

For now, no ban exists. If you are a business already using Kimi K3, the sensible step is to ensure you are running it on your own infrastructure, not routing data through external Chinese-controlled servers.
